Married Women’s Maintenance Act – At the Police Court, yesterday, Edward Toy, bricklayer, of Quinton, was charged with deserting his wife, - Complainant said she was married to the defendant in March 1890, and afterwards lived at Quinton. Defendant had illused and abused her, telling her to take her “hook” and threatened to knock her head against the wall. He had taken the furniture from the house. There were three children by the marriage, and the defendant had taken to two, and she had one. Defendant could earn 20s a week. – An order was made for the defendant to contribute 5s, a week towards the maintenance of his wife.

Typed exactly as I've seen it.. marriage date a problem, I think it should read 1881 and unfortunately doesn't mention the wifes name.

The boys ended up in Chester in 1901 census in District Certified Industrial School in Chester. The girl was with her grandmother in the same census.

Wow, so he was a wife beater? My goodness. That would explain a hell of a lot, and why my Grandfather's sister would say her father Thomas Toye was reluctant to speak about his early childhood.

Right, I've just gone through the thread again and I'm afraid I am lost.

Also as a gap filler, I noticed on the 1911 census, it had Helen (Ellen) Toye as having 4 children, 1 died. I didn't know this before, but it got me thinking about the child, so a look on the LDS site and also Ancestry I have found a Nellie Toy b1886 d1886 in Stourbridge.

Now I'm not as familiar with the area as some, but is that possible to be my missing baby whose family lived in Quinton? There is no other Toy's who were within the timeline of 1881 and 1890 when the marriage broke down.

Nellie Toye's birth in 1886 was registered in the Kingswinford sub district of Stourbridge. Records are held at Dudley Register Office; if you wanted to order the certificate from them, the reference is: KIN/132/99. The death is also registered in Kingswinford sub district, reference KIN/072/106.

If the family were living at Quinton, I would have expected the birth to be registered in Halesowen sub district. However, in my experience, sometimes (particularly for first children) women went back to their mother's house to give birth - I would imagine to benefit from mother's experience and support, so I don't think you can necessarily rule it out.

It could be that Nellie was born in Wordsley workhouse, that would come under Kingswinford.
