Could anyone tell me what the age of consent would have been around 1860. I have found my great grand mother in the 1861 census she is aged 9 and listed as the daughter in law of the head of the household.

Steve, it's possible that she is the Stepdaughter of the head of the household (a common error on many census)

Or granddaughter, age of consent was 12 for girls and 14 for boys it was raised to 16 in 1837.

That was colloquial for what we now term a stepdaughter.
