So cross and I dont get cross very often!

Excuse me for venting!
My daughter had her mobile stolen the other day. She works in a restaurant, and it was left in the office. A customer went in the office and took it.
They have video of it, police have been in and taken the footage, said it was bulgary.
Crime numbers given to the insurance, had to wait up to 72 hrs because it was referred. But they have come back and said, it was in a public place so she cant claim!
Almost £9 a month she pays for insurrance, so now, heavily pregnant and in poor health, no phone and still has monthly payment pay!

Shocking! Oh am so cross!

restaurant might be public but the offices aint

just say a banks a public place so if i get caught in the vault thats public too see what they say

dont think they would take it to a small claims court if you threatend it as they will have costs too which will me more than paying for the phone? try it

also threaten to go to trading standard as well as publishing the fact on your public twitter, blog and facebooks pages and tell them you will get all you links to do the same then ask them how would they like this type of advertisment for the product see what they say after all that

but get back on to them there trying to fob you off

After the floods in Australia over the last few months we have had houses next to each other with different insurance companies getting different treatment.

One company would say the flooding was caused by overflowing muncipal drains and not covered.

Another company would say that it was flash flooding caused by excessive rain so they are covered.

Insurance companies will often refuse your claim hoping that you will go away.

Like England, we have insurance ombudsman to sort it out if they don't listen to reason.

I am sure if your daughter presented the police report to the ombudsman the insurance company would be told to stop the B.S. and hand over the dough.

Im going to sit with her this afternoon to appeal against the decision.
Thanks for the link Mallosa, Ive kept that so if we dont get anywhere I will go to them.

The policy says,
"What is not covered.
Claims if your mobile is left unattended in
a public place, or in a vehicle, unless the vehicle
is securely locked and the mobile is placed out
of view."

Although it was in the office they have said it is easily accessible by the public.

Could do without this!

If you don't get anywhere, it's always worth sending letters to various newspapers/consumer programs with a copy to the insurance company saying who you've sent it to. Always seems like the threat of adverse puplicity seems to change the insurance companies minds! Anyway worth a go!

The fact that the police say it is burglary means that Section 9 of the Theft Act 1968 is being applied.

I can give an example as well.

In one of my computer stores some people kept my sales staff busy whilst another snuck into our stock room and pinched a couple of Notebbook computers.

They were not charged with shop lifting but burglary.

But this is Australia so our definitions coul dbe different.

Same in Denmark, one of my girlfriends works in an Estate Agents, some prospective buyers came in, and during the time they were in there one of them asked to use the staff loo, later she found out they'd nicked her car keys and the car was also gone!
It was reported to the police, but they didn't really do anything. They actually ended up locating the car themselves (in a rough part of town), the Police weren't interseted in fingerprints etc, so he drove the car home. Insurance coughed up for changing the locks, and repairing the damage as well as for items that were stollen from the car.

I was also, putting it mildly, gobsmacked when my husband managed to accidentally set fire to his house. He said straight away that it was his fault as he'd left a candle burning, insurance paid up no problem -in fact the contents insurance came through about two weeks after he put the claim in, the house insurance took a bit longer but only becuase it's a complicated affair to assess the amount of damage done. He ended up paying a fine to the police for carelessness, but that was only about £200! I had expected that as soon as he admitted fault that the insurance company wouldn't pay up!
