I've re-sent the photo to Nl. The headstone quite clearly reads 1864, and gives his age as 37. His name is also first on the headstone, so presumably the first buried.

wonder why not in the actual register and why we cant find a death
A check of the PR for St Lukes, Cradley Heath has failed to find a burial for Samuel Tibbetts, despite a headstone in the churchyard giving his details. Several of us have seen a picture of the headstone.
Looking again at the picture of the headstone:
The first three names look as if they were engraved at the same time. That is Samuel (d. 29 Sep 1864), John (d. 17 May 1877) and Fanny (d. 20 Apr 1899), followed by a prayer, before Emma's details were added, and finally Joseph Dimmock. So, perhaps the stone was first used for the burial of Fanny in 1899 and Emma took the opportunity to add the details for Samuel and John. Also, Emma may have mis-remembered the actual date of Samuel's death if the stone was first erected in 1899.
Perhaps the next step is to see if there is a record of either the burial of John or Fanny in the church records. If there is no burial for John at Cradley Heath, it is likely that the headstone was erected well after the deaths of Samuel and John. I would, however, expect to find a record of the burial of Fanny in the PR.
In the meantime, the search goes on for any record of Samuel's death.

If this isn't the husband of Emma Clee, who is it? The time between the death in Birmingham (possibly on 29 September) and the burial in Cradley Heath on 4 October looks about right. So, maybe, when Emma had the headstone erected in 1899, she had the day right, but the year and age wrong?
This date for the death also gives legitimacy to more of Emma's children.
We have a baptism for this Samuel at Cradley on 22 Jan 1832, which was always at odds with the age and dates given on the headstone. The 'new' year is a better fit.
